General Privacy Policy

Makai Technologies, Inc. (“Makai,” “we,” “us,” or “our”) is committed to protecting your privacy. This General Privacy Policy (“Policy”) describes how we collect, use, disclose, and safeguard your information when you use the Makai mobile application, website at https://www.themakaiapp.com, and related services (collectively, the “Services”). This Policy applies to all users worldwide, including users in the European Economic Area (“EEA”), the United Kingdom (“UK”), and U.S. states with comprehensive privacy laws.

Information Collection and Use

Personally Identifiable Information

When you register with us through the Services and become a Vendor or a Customer, when you choose to post a Listing or reserve a trip, or when you wish to contact another Vendor, we will ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (“Identity Information”). Identity Information includes, but is not limited to:

  • your name,
  • phone number,
  • driver's license,
  • email address, and
  • home postal address,

but does not include your credit card number or billing information.

In order to process some of your transactions through the Services, we may also ask for your credit card number and other billing information (“Billing Information”) (Identity Information and Billing Information together, “Personal Information”).

Some Personal Information is required, like your name and email address. Other Personal Information is optional, like your date of birth.

We use your Personal Information to provide the Service and administer your inquiries.

We collect Personal Information in connection with your registration to join the Service. You can register to join via the Site or Services by completing the required forms.

Third Party Accounts

You can also register on Makai by logging into online accounts you may have with third party service providers (“TPA”) (e.g. Facebook, Apple, Google); each such account is considered a “Third Party Account” on our Site or Application as described below. As part of the functionality of the Site, Service and Application, you may link your Makai Account with Third Party Accounts, by either:

  • Providing your Third-Party Account login information for Makai through the Site, Service or Application; or
  • Allowing Makai to access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account.

You represent that you are entitled to disclose your Third-Party Account login information to Makai and/or grant Makai access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating Makai to pay any fees or making Makai subject to any usage limitations imposed by the Applicable TPA.

If you decide to register by logging into a Third Party Account via our Site or Application, we will obtain the Personal Information you have provided to the applicable TPA (such as your “real” name, email address, profile pictures, names of TPA friends, names of TPA groups to which you belong, other information you make publicly available via the applicable TPA and/or other information you authorize Makai to access by authorizing the TPA to provide such information) from your Third Party Account and use that information to create your Makai Account and Makai Account profile page and you will become a Vendor or a Customer. Depending on the Third Party Account you choose and subject to the privacy settings that you have set in such Third Party Account, you understand that by granting us access to the Third Party Account, we will access, make available and store (if applicable and as permitted by the TPA and authorized by you) the information in your Third-Party Account so that it is available on and through your Makai Account on the Site, Service and Application. If there is information about your “friend” or people with whom you are associated in your Third-Party Account, the information we obtain about those “friends” or people with whom you are associated, may also depend on the privacy settings such people have with the applicable TPA.

Non-Identifying Information

We also collect the other information that you provide as part of registration and the administration and personalization of your Makai Account profile (e.g. without limitation, zip code (on its own) and individual preferences or demographic information (“Non-Identifying Information”).

We use your Personal Information (in some cases, in conjunction with your Non-identifying Information) mainly to provide the Service, complete your transactions, and administer your inquiries.

Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your demographic information). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Makai Users (defined below) to attempt to provide you with a better experience, to improve the quality and value of the Service and to analyze and understand how our Services are used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.

We also use your Personal Information to contact you with Makai newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your “Notifications” information. (See “Changing or Deleting Information” below). We may also share the combined information without aggregating it to partners we feel may have material benefit to you or your use of the Site. Please note that we may also use your Personal Information to contact you with information related to your use of the Service, or services from Partners, you may not opt out of these notifications.

Categories of Personal Information We Collect

In accordance with the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”) and other applicable state privacy laws, we disclose the following categories of personal information we have collected in the preceding twelve (12) months:

  • Identifiers: Name, email address, phone number, mailing address, IP address, device identifiers, Makai account ID.
  • Financial Information: Credit/debit card number (processed and stored by Stripe, our payment processor), Stripe Connect account information for Owners, transaction history, payout records.
  • Commercial Information: Booking history, vessel listings, pricing information, transaction amounts, service fees paid.
  • Internet/Network Activity: Browser type, operating system, pages viewed, links clicked, referring URL, session duration, app usage data.
  • Geolocation Data: Precise GPS coordinates when using the mobile app (with your permission), approximate location derived from IP address.
  • Professional/Employment Information: Captain credentials, maritime licenses, USCG certifications (for Owners and Captains).
  • Government-Issued Identifiers: Driver's license number (for identity verification).
  • Audio/Visual Information: Profile photos, vessel images you upload, recorded customer service calls (with notice).
  • Inferences: Preferences, characteristics, and behavior derived from the above categories to provide personalized recommendations.

How We Use Your Information

We use the information we collect for the following purposes:

  • To provide and maintain the Services: Processing bookings, facilitating payments, connecting Renters with Owners, and enabling communication between parties.
  • To verify identity and prevent fraud: Verifying captain credentials, preventing duplicate accounts, detecting fraudulent transactions, and protecting against unauthorized access.
  • To process payments: Processing booking payments, issuing refunds, managing security deposits, and facilitating Owner payouts through Stripe Connect.
  • To communicate with you: Sending booking confirmations, trip reminders, safety notices, and responding to your inquiries.
  • To improve our Services: Analyzing usage patterns, conducting research, and developing new features.
  • To comply with legal obligations: Responding to legal process, enforcing our terms, and meeting regulatory requirements including maritime safety regulations.
  • To send marketing communications: With your consent, sending newsletters and promotional offers (you may opt out at any time).

Lawful Basis for Processing (EEA/UK Users)

If you are located in the European Economic Area or the United Kingdom, we process your personal data only when we have a valid legal basis under the General Data Protection Regulation (“GDPR”) or the UK GDPR:

  • Performance of a Contract (Article 6(1)(b)): Processing necessary to provide you with the Services, including booking management, payment processing, identity verification, and communication between Renters and Owners.
  • Legitimate Interests (Article 6(1)(f)): Fraud prevention, platform security, service improvement, analytics, and enforcement of our Terms. We balance our interests against your rights and freedoms and do not process where the impact would be disproportionate.
  • Legal Obligation (Article 6(1)(c)): Compliance with maritime safety regulations, tax reporting, anti-money laundering requirements, and responses to lawful government requests.
  • Consent (Article 6(1)(a)): Marketing communications, non-essential cookies, and precise geolocation tracking. You may withdraw consent at any time without affecting the lawfulness of prior processing.

Your Rights Under the GDPR (EEA/UK Users)

If you are located in the EEA or UK, you have the following rights with respect to your personal data:

  • Right of Access (Article 15): You may request a copy of the personal data we hold about you.
  • Right to Rectification (Article 16): You may request that we correct inaccurate or incomplete personal data.
  • Right to Erasure (Article 17): You may request deletion of your personal data, subject to our legal obligations to retain certain records (e.g., financial transaction data for tax compliance).
  • Right to Restriction (Article 18): You may request that we restrict the processing of your personal data in certain circumstances.
  • Right to Data Portability (Article 20): You may request a copy of your personal data in a structured, commonly used, machine-readable format.
  • Right to Object (Article 21): You may object to processing based on legitimate interests or direct marketing.
  • Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with your local data protection supervisory authority.

Your Rights Under California Law (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share your information.
  • Right to Delete: You may request that we delete your personal information, subject to certain exceptions (e.g., completing a transaction, detecting fraud, complying with legal obligations).
  • Right to Correct: You may request that we correct inaccurate personal information.
  • Right to Opt Out of Sale/Sharing: We do not sell your personal information for monetary consideration. We may share certain information with analytics and advertising partners for targeted advertising purposes. You have the right to opt out of such sharing.
  • Right to Limit Use of Sensitive Personal Information: You may limit our use of sensitive personal information (such as precise geolocation) to only what is necessary to provide the Services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To submit a verifiable consumer request, contact us at privacy@themakaiapp.com or write to Makai Technologies, Inc., Florida, United States. We will verify your identity before processing your request. You may also designate an authorized agent to make a request on your behalf; we may require written authorization and verification of the agent's identity.

We will respond to your request within 45 days. If we need additional time, we will notify you and may take up to an additional 45 days (90 days total).

Additional U.S. State Privacy Rights

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), and other states with comprehensive privacy laws have rights similar to those described above, including the right to access, correct, delete, and port your personal data, as well as the right to opt out of targeted advertising, the sale of personal data, and profiling for decisions that produce legal or similarly significant effects.

To exercise these rights, contact us at privacy@themakaiapp.com. If we decline your request, you may appeal our decision by contacting us at the same address. If you are unsatisfied with our response to your appeal, you may contact your state's attorney general.

Global Privacy Control

We recognize and honor the Global Privacy Control (“GPC”) signal. When we detect a GPC signal from your browser, we will treat it as a valid opt-out of the sale or sharing of personal information associated with that browser.

International Transfer

Your information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Makai transfers personal information to the United States and processes it there.

For transfers of personal data from the EEA or UK to the United States, we rely on the EU-U.S. Data Privacy Framework and, where applicable, Standard Contractual Clauses approved by the European Commission. You may request a copy of the applicable Standard Contractual Clauses by contacting us at privacy@themakaiapp.com.

Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected and to comply with our legal obligations. Specific retention periods are as follows:

  • Account data: Retained for the duration of your account and for 30 days following account deletion to allow for recovery, then deleted or anonymized.
  • Booking and transaction records: Retained for 7 years following the transaction date to comply with tax reporting and financial record-keeping requirements.
  • Captain credentials and maritime licenses: Retained for the duration of the account plus 3 years, as required by maritime safety regulations.
  • Customer service records (including call recordings): Retained for up to 2 years.
  • Marketing consent records: Retained for as long as consent is active, plus 3 years following withdrawal to demonstrate compliance.
  • Log data and analytics: Retained for up to 26 months, then aggregated or deleted.
  • Dispute and incident records: Retained for 7 years or as required by applicable statutes of limitation.

Compliance with Laws and Law Enforcement

Makai cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, at our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), to protect the property and rights of Makai or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity.

Changing or Deleting Your Information

All Vendors and Users may review, update or correct their Personal Information by editing the relevant part of their profile or by contacting us via support@themakaiapp.com. If you would like us to cancel your Makai Account, please contact us and we will attempt to accommodate your request if we do not have any legal obligation or a legitimate business reason to retain the information contained in your Makai Account. Please note that, if you cancel your Makai Account, any reviews you have posted via the Services will remain publicly viewable via the Services unless you specifically request their removal.

Confidentiality

Except for any personally identifiable information we may collect from you under the guidelines established in our Privacy Policy, any content posted to the Site will be considered non-confidential and non-proprietary. You are responsible for maintaining the confidentiality of your Account and password, whether or not you thereof authorize use.

Location Data

When you use the Makai mobile app by Makai Technologies Inc., Makai may collect and process information about your actual location. We use GPS coordinates to determine your location while using the app or while it is turned on in the background. We use this information to better tailor our services to you and others. This information will not be shared with third parties unless in compliance with a lawful government request or legal process or unless you request for us to do so.

You may disable location services through your device settings at any time. Disabling location services may limit certain functionality of the app, such as the ability to view vessels near you. We do not collect precise geolocation data without your explicit consent. On iOS, you can choose “While Using the App,” “Always,” or “Never” for location access. On Android, you can manage location permissions in your device Settings.

Phishing

Identity theft and the practice currently known as “phishing” are of great concern to Makai. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your Makai Account ID, login password, or national identification numbers in a non-secure or unsolicited email or telephone communication.

Aggregate Information and Non-Identifying Information

We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain your Personal Information.

Cookies, Tracking Technologies, and Consent

Like many websites, we use “cookies” to collect information. A cookie is a small file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for the following purposes:

  • Strictly Necessary Cookies: Required for the Services to function (e.g., authentication, security). These cookies cannot be disabled.
  • Functional Cookies: Remember your preferences and settings to enhance your experience.
  • Analytics Cookies: Help us understand how visitors interact with the Services by collecting and reporting information anonymously.
  • Advertising/Marketing Cookies: Used to deliver relevant advertisements and track the effectiveness of our marketing campaigns.

For users in the EEA, UK, and jurisdictions that require consent for non-essential cookies, we will request your consent before placing analytics or marketing cookies. You can manage your cookie preferences at any time through your browser settings. If you do not accept cookies, however, you may not be able to use all portions or functionality of the Service.

We also use web beacons (sometimes called single-pixel gifs) along with cookies to compile aggregated statistics to analyze how our Services are used and may be used in some of our emails to let us know which emails and links have been opened by recipients.

Do Not Track Signals

We honor the Global Privacy Control (GPC) signal as a valid opt-out request. We do not currently respond to the legacy Do Not Track (DNT) browser signal, as there is no industry-standard technology for recognizing or honoring DNT signals.

Service Providers and Third-Party Sharing

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Site and Application-related services (e.g. without limitation, maintenance services, database management, web analytics, fraud detection services relating to the activity of Makai Users and improvement of the features of the Service) or to assist us in analyzing how our Services are used. These third parties may have access to your Personal Information; if they do, this access is only so that they may perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose.

Our key service providers include:

  • Stripe: Payment processing and Owner payouts.
  • Firebase (Google Cloud): Authentication, database, cloud functions, and push notifications.
  • SendGrid: Transactional and marketing email delivery.
  • Amazon Web Services: Cloud hosting and infrastructure.
  • Vercel: Website hosting.

We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. You can, at any time, opt out of receiving such communications.

Log Data

When you visit the Services, whether as a Vendor or a non-registered User just browsing (any of these, a “Makai User”), our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as your computer's Internet Protocol (“IP”) address, browser type or the webpage you were visiting before you came to our Services, pages or features of our Services that you visit or use, the time spent on those pages, information you search for on our Services, access times and dates, and other statistics. We use this information to monitor and analyze use of the Services and for the technical administration of the Services, to increase the functionality and user-friendliness of the Services, and to better tailor our Services to our visitor's needs. We also use this information to verify that visitors to the Services meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

Our Policy Towards Children

The Site and Application are not directed to individuals under 18. We do not knowingly collect personally identifiable information from children under 13 (or under 16 in the EEA/UK). If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at privacy@themakaiapp.com.

If we become aware that a child under 13 (or under 16 in the EEA/UK) has provided us with Personal Information, we will take steps to promptly delete such information from our files. In compliance with the Children's Online Privacy Protection Act (“COPPA”), we do not knowingly collect, use, or disclose personal information from children under 13.

Information We Gather When You Communicate with Us and/or Other Makai Users

Analyzing Your Communications

We may review, scan, analyze and store all communication (including emails, phone calls, messages, etc.) sent or received using Makai communication tools, (including communications with other Users) for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research and customer support purposes. For example, as part of our fraud prevention efforts, we scan and analyze messages to mask contact information and remove references to other websites. In some cases, we may also scan, review, or analyze messages to debug, improve and expand product offerings. Automated methods are used whenever reasonably possible; however, we may need to manually review some communications occasionally. This may be done to provide customer support, conduct fraud investigations as well as assess and improve the functionality of these automated tools. We will not review, scan, analyze or store your communications to send third party marketing messages to you, and we will not sell reviews or analyses of these communications.

We reserve the right to block the delivery of or review communications that we, at our sole discretion, believe may contain malicious content, spam, or that may pose a risk to you, our Users, Makai, or others.

These communications and their contents may be disclosed in response to lawful government requests or legal process, in other circumstances in which we have a good faith belief that a crime has been committed by a user of our services, that an emergency exists that poses a threat to the safety of our users or another person, if necessary to protect our rights or property, or for us to render the service you have requested.

User-Vendor Communications

You agree that, with respect to other Vendors' or Users' personal information that you obtain directly or indirectly from or through the Website or through any Website-related communication, transaction or software, we have granted to you a license to use such information only for:

  • Website-related communications that are not unsolicited commercial messages
  • Using services offered through the Website, and
  • Inquiring about or otherwise facilitating a financial transaction between you and the other Vendor or User related to the purpose of the Website (such as inquiring about or booking an online fishing trip and transacting payment).

Any other purpose will require express permission from the User and written permission from a Makai Inc. representative. You may not use any such information for any unlawful purpose or with any unlawful intent. If it is discovered that a Vendor is using customer information obtained through Makai to then book the customer directly and avoid paying Makai commission, this will result in termination of the Vendor's account.

Messaging via a Makai Account

As part of the Service, Makai Users may communicate with Makai Captains through use of the “Message Captain” feature on the Services.

Recording Phone Calls

Please note that calls to and from Makai may be recorded. We may use the call recordings to monitor our customer service for quality or compliance purposes, to check the accuracy of the information or to provide training to our staff. We will keep the call recordings for as long as is reasonably necessary to perform such activities (up to 2 years) and then delete them. Any personal information accessed during these calls will be treated in accordance with this Privacy Policy and its provisions.

Makai Captains and Customers

Captains

When you create a Makai Account, we will set up a Makai Account profile page for you. Your Makai Account profile page will include your first name and last name and connections you have established between your Account and any TPAs, and a biography and links to your Listings. You can select the other items of Personal Information that you wish to be included in your Makai Account profile page — including, but not limited to, a profile picture, or other information known as your “Profile Information”. We will display your Profile Information in your Makai Account profile page publicly via the Services, and with your prior permission, on third party sites. Any information you choose to provide as part of your Profile Information will be publicly visible to all Makai Users and consequently should reflect how much you want other Makai Users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage Vendors to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your Profile Information at any time.

Customers

When you create a Makai Account, we will set up a Makai Account profile page for you. Your Makai Account profile page will include your first name and last name and connections you have established between your Account and any TPAs. You can select the other items of Personal Information that you wish to be included in your Makai Account profile page, including, but not limited to, a profile picture, or other information known as your “Profile Information”. Any information you choose to provide as part of your Profile Information will be visible to Captains with whom you choose to interact and on any public reviews you post and consequently should reflect how much you want other Makai Users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage Customers to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your Profile Information at any time.

Listings

If you post a Listing, we may publish that Listing publicly via the Services and may enable third parties to publish your Listing on their website through the use of an HTML “widget”. We may also display the geographical location of your Listing in the form of a map to potential Users. For privacy, the map display shows an approximate area, not the precise coordinates of your vessel.

If you request to make a booking via the Services, Makai will share the following information about you with the applicable Vendor: your first and last name, and a link to your Makai Account profile page where the Vendor can view your booking history, reviews and description.

All of this information will enable the Vendor to decide whether to confirm or reject your booking. When a Vendor confirms a booking, we will share pieces of the Vendor's Identity Information, including, but not limited to, full name, phone number, the Vendor's address and the Vendor's email address, with the applicable User selected by the Vendor and we will share pieces of the User's Identity Information with the Vendor, including, but not limited to, full name, phone number and email address, so that the User and Vendor may contact one another directly. In no event is a User's Billing Information shared with a Vendor.

Links to Other Websites

Our Services may contain links to other websites. If you choose to visit an advertiser by “clicking on” a banner ad or other type of advertisement, or click on another third-party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites and are not responsible for their privacy practices or content.

Data Breach Notification

In the event of a data breach affecting your personal information, we will notify you in accordance with applicable law. For U.S. residents, we will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement, or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

For users in the EEA or UK, where a breach is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay, and in any event within 72 hours of becoming aware of the breach where feasible. We will also notify the relevant supervisory authority.

Security

Makai is very concerned with safeguarding your information. When you enter sensitive information (such as credit card number) on our registration or order forms, that information is transmitted directly to our payment processor (Stripe) using industry-standard encryption (TLS 1.2 or higher). We do not store your full credit card number on our servers.

We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it, including encryption at rest and in transit, access controls, and regular security assessments. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. If you have any questions about security on our Services, you can contact us via support@themakaiapp.com.

Access to Your Account

Makai will have the right to access your account to make any changes to reservations, listings, or profile information at its sole discretion for the purpose of platform administration, fraud prevention, and compliance with legal obligations.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. If we make material changes, we will notify you by posting a notice on the Services or sending you an email before the changes become effective. We will update the “Last Updated” date at the top of this Policy. We encourage you to periodically review this page for the latest information on our privacy practices.
